Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Kitly website at dkolla.com/kitly and the Kitly Android app (package com.dkolla.kitly), together the "Services", operated by Pink Sky, a sole proprietorship based in Karachi, Pakistan ("we", "us"). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

2. The Services

Kitly provides tools to convert and resize images, work with PDFs, scan documents and, in the Android app, save videos from links. The image, PDF and scanner tools run on your device. Features may be added, changed or removed at any time.

3. Eligibility

You must be old enough to form a binding contract in your country, or have a parent or guardian's permission. The Services are not directed to children under 13. If you use the Services on behalf of an organisation, you confirm you have authority to accept these Terms for it.

4. Acceptable use

You agree not to:

• use the Services to infringe copyright, trademark, privacy or other rights of anyone;
• process, store or share content that is unlawful, abusive, or that sexually exploits or endangers children;
• circumvent copy protection, DRM, paywalls, geo-restrictions or access controls;
• attempt to disrupt, overload, probe or gain unauthorised access to our servers or systems, or use automated means to abuse the Video Saver service;
• reverse engineer, decompile or copy the App except as the law allows, or remove notices from it;
• resell or repackage the Services without our written permission.

5. Your files and content

You keep all rights to your files. Image, PDF and scanner tools process files on your device, and we do not receive them. You are responsible for the content you process and for having the right to do so. Keep your own backups: we are not responsible for lost, damaged or altered files, and results (such as compressed or converted files) may differ in quality from the originals.

6. Video Saver and third-party content

Video Saver lets you save videos from links you provide. You may use it only for content that you own, that you have permission to download, or that the owner makes available for downloading, and only where the law and the source site's terms allow it. You are solely responsible for how you use it. We do not host, own or control third-party content, we do not support downloading from YouTube, and we do not help to bypass DRM or other protections. We may block sites, remove features or refuse requests at any time, including to comply with law or platform policies. If you believe content is being saved in violation of your rights, contact us at support@dkolla.com.

7. Premium subscriptions

• Kitly Premium is an optional auto-renewing subscription (monthly, quarterly, six-monthly or yearly) sold through Google Play. Prices are shown in the App before you buy and may vary by country and taxes.
• Payment is charged to your Google Play account at confirmation of purchase and renews automatically unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel any time in Google Play > Payments & subscriptions > Subscriptions. Deleting the App does not cancel your subscription.
• Refunds are handled by Google Play according to its policies. We cannot process refunds for Google Play purchases directly.
• Premium removes ads. We may change features or pricing for future periods, and will tell you in advance where required.

Website Premium

• Website Premium removes the free limits on the Kitly website (for example batch size, file size, scanner pages and Video Saver length). The current limits and prices are shown on the Premium page and may change for future purchases.
• It is prepaid for the period you choose (1, 3, 6 or 12 months), paid once, and does not renew automatically. Buying again before it ends adds the new period to your current end date.
• You need a Google account to sign in. Payments are processed by Bank Alfalah's payment gateway in Pakistani rupees; your card issuer may convert other currencies and charge fees.
• Website Premium works on the Website only. It does not unlock features or remove ads in the Android App, and the App's Google Play subscription does not unlock the Website.
• Because Premium is activated immediately, payments are generally non-refundable. We will refund or extend your Premium if a payment was taken in error, you were charged twice, or Premium could not be used because of a fault on our side. Contact support@dkolla.com within 14 days with the email you signed in with.
• We may suspend Premium without refund if an account is used to break these Terms.

8. Advertising

The free version of the App is supported by ads from Google AdMob. Please do not click ads fraudulently or use tools to generate ad impressions or clicks. Advertisers are third parties and we are not responsible for their products or offers.

9. Intellectual property

The Services, including the Kitly name, logo, design and software, are owned by us or our licensors and are protected by law. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App and Website according to these Terms. Open-source components used in the Services remain under their own licences.

10. Third-party services

The Services depend on third parties such as Google Play, Google AdMob, Google Drive (if you use backup) and Google Analytics. Your use of those services is governed by their terms. We are not responsible for them.

11. Availability and changes

We try to keep the Services running but do not promise uninterrupted or error-free operation. We may suspend, change or discontinue any part of the Services, with or without notice.

12. Disclaimer of warranties

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent allowed by law. We do not warrant that the Services will meet your needs, that results will be accurate or free of loss of quality, or that third-party sites will remain compatible with Video Saver.

13. Limitation of liability

To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us for Premium in the 12 months before the claim or (b) USD 20. Some laws do not allow certain limits, so parts of this section may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to defend and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your content, your use of the Services in breach of these Terms, or your violation of any law or third-party rights, in particular your use of Video Saver.

15. Termination

You may stop using the Services at any time by uninstalling the App or leaving the Website. We may suspend or end your access if you break these Terms or if needed to protect the Services or comply with law. Sections that by nature should survive (including 5, 6, 9, 12, 13, 14 and 16) will survive termination.

16. Governing law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Courts in Karachi, Pakistan have jurisdiction, except where mandatory consumer laws in your country give you the right to bring claims elsewhere. We encourage you to contact us first to try to resolve any issue informally.

17. Changes to these terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, give notice in the App or on the Website. Continuing to use the Services after the change means you accept the updated Terms.
